These terms of use apply to the NEXSTR app (package name com.tesyoholdings.nexstr, hereby referred to as "Application") for mobile devices that was created by Tesyo Holdings LLC (hereby referred to as "Service Provider") as a Free service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
NEXSTR is a high-performance video player for Android devices. The Application supports playback of common video file formats, hardware-accelerated decoding, subtitle rendering, and casting to compatible external displays. The Application does not include any pre-loaded video library and does not act as a content distribution platform.
You must be at least 13 years of age to use the Application. If you are between 13 and the age of legal majority in your jurisdiction, you must have your parent's or guardian's permission to use the Application and agree to these terms on your behalf.
You agree that you will not use the Application to:
The Service Provider does not pre-screen, monitor, or control the video files or network streams that you choose to play through the Application. You bear sole and exclusive responsibility for the content you access.
The Application may allow you to play video files from third-party sources (including local files, cloud storage providers, and network streams). The Service Provider makes no representation or warranty regarding the legality, accuracy, quality, or appropriateness of any third-party content. Reference to or playback of any third-party content does not constitute endorsement by the Service Provider.
Certain features of the Application may be offered as part of a paid subscription (the "Premium Tier"). All payments are processed through the Google Play billing system and are subject to Google Play's standard terms. Subscriptions renew automatically unless cancelled in your Google Play account at least 24 hours before the renewal date. Refunds are governed by Google Play's refund policy. The Service Provider may modify subscription pricing or features with reasonable advance notice.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or to change pricing of their paid features at any time and for any reason. Any charges will be clearly communicated to you in advance.
The Service Provider may wish to update the Application at some point. The Application is currently available as per the requirements for the operating system. Operating system requirements may change, and you will need to download the updates if you want to continue using the Application. The Service Provider does not guarantee that it will always update the Application so that it is relevant to you and/or compatible with the particular operating system version installed on your device.
The Service Provider may also wish to cease providing the Application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination: (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the Application, and (if necessary) delete it from your device.
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your device and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your device, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your device to malware, viruses, malicious programs, compromise your device's security features, and may result in the Application not functioning correctly or at all.
Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the Application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the Application, or other third-party charges. By using the Application, you accept responsibility for any such charges, including roaming data charges if you use the Application outside of your home territory without disabling data roaming. If you are not the bill payer for the device on which you are using the Application, they assume that you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the Application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

The Application is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. The Service Provider does not warrant that the Application will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected. To the maximum extent permitted by applicable law, the Service Provider disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, in no event shall the Service Provider be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Application; (b) any conduct or content of any third party on the Application or in any content you play through the Application; or (c) unauthorized access, use, or alteration of your transmissions or content.
These terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms shall be resolved through binding arbitration in Delaware, in accordance with the rules of the American Arbitration Association.
The Service Provider may periodically update these Terms of Use. You are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms of Use on this page. Continued use of the Application after such changes constitutes your acceptance of the new terms.
